EDDA YA KIISLAM IMETOLEWA UFAFANUZI SAWIA

Question: Waiting period (Iddah) is prescribed in Islam after divorce and death. Write about it? Answer Introduction: The term “Iddah” comes from an Arabic word “الْعِدَّة” translated into English as “preparing”or “waiting”. Therefore, Iddah refers to the period of time that follows a woman’s divorce or death of her husband. The length of this waiting period varies somewhat based on the situation and whether it is Iddah of divorce or death. Iddah from Qur’an and Sunnah The term is found in many verses such as this verse in sura Talaq verse 1 in which Allah says;- يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاء فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ وَأَحْصُوا الْعِدَّةَ وَاتَّقُوا اللَّهَ رَبَّكُمْ “Oo Prophet, when you divorce women, divorce them while in their Iddah and count the Iddah and fear Allah your Lord..”(Qur’an 65:1). This verse speaks about Iddah of a divorced woman. For the Iddah of a woman of whom her husband has died, Allah says in the Qur’an, thus;- “And those of you who die and leave wives behind them, they (the wives) shall wait for four months and ten days, then when they have fulfilled their term, there is no sin on you for what they will do about themselves (concerning marriage) in a just and hanourable manner. And Allah is well acquainted with all that you do”(Qur’an 2:234) . In this verse, contrary to Qur’an 65:1, the Qur’an speaks of wives waiting for four months and ten days as an Iddah of death. Proofs of Iddah from Sunnah. Iddah of death. As for Iddah of death in Sunnah, it is narrated by Ummi Salamah that “ a woman came to the Messenger of Allah (may peace and blessings of Allah be upon him) and asked saying‘my daughter’s husband has died and her eyes are aching, can we apply kuhl to her? He (the messenger of Allah) replied, No, No, No and then said ‘it is (Iddah) four month and ten (days)…”(Bukhari and Muslim) Iddah of divorcee It has been narrated by Aisha that “Barirah was ordered (by the Prophet)to count three monthly periods as a waiting period” (Ibn Majah) Therefore, Iddah is an act of worship prescribed by Qur’an and Sunnah to a woman whether a divorcee or when one’s husband dies and it is obligatory “faradh”to a woman and the society must see to it that a woman eligible for it fulfils this obligation. The wisdom behind prescription of Iddah Many people ask what is the wisdom behind the prescription of Iddah in Islam? There are many reasons given and among these are;- •To identify pregnancy The Iddah gives sufficient time to a woman to make sure she isn’t pregnant. This is necessary to prevent confusion that could arise on who the father of the child is if the woman were to remarry and get pregnant right away after the death of their husbands or divorce. Some people argue that since nowadays presence of absence of pregnancy can be proved by medical examination or even on the spot test at home or anywhere, there is no need for Iddah. Such arguments do not hold water. We can’t change that which Allah and His Prophet has prescribed citing technological development. If we begin doing that, we will end up reforming Islam just like Christians did to reform Isa (alayhi salaam) teachings to their liking and Jews changed Musa (‘layhi salaam) teachings to their liking. For example, nowadays we can set automatic watch to give as an adhan i.e. call to prayer, automatically and do away with Muad-dhins. Will that be okay? Definitely not correct. •Give time for reconciliation When a divorce takes place, Iddah offers time to the couple to cool down and give the divorce a second thought. •Exemplify the gravity and sanctity of marriage Iddah prevents people from taking marriage to be a light or fan affair. Marriage is so sacred and significant that its dissolution by divorce results in a waiting period. •Time to express grief In the case of the husband passing away, the wife has been given to grieve. (Refer the book “Al-fiqh al-islami wa adillatuhu by Dr Wahbatu az-Zhuhayl) Types of Iddah There are different types of Iddah according to a particular situation as follows;- a) For a divorced woman 1) For that divorcee who is mature, menstruates and isn’t pregnant (Iddah is for 3 menstrual cycles). Upon the expiry of her third period, she will be now free to leave the house of her former husband and can marry whom she wants. Allah says, “And divorced women shall wait (as regards their marriage) for three menstrual periods,...” (Al-Baqarah 2:228) 2) Three consecutive Islamic months For that divorcee who isn’t menstruating. This will include those women who have entered menopause. Likewise, for some medical reason, those young women who don’t experience menstruation will also be obliged to observe three months as the waiting period. 3) Duration of pregnancy That divorcee which was pregnant will be in Iddah until she delivers her baby. Note, an exception is that if a woman is divorced before the marriage being consummated i.e. before having sexual intercourse between the husband and wife, there is no Iddah upon the woman for that matter. b) Iddah of death of a husband 1) Four months and ten days When a husband passes away, his wife will have to observe the Iddah of four months and ten days.(Qur’an 2:234). She should live in the house she used to live in at the time of her husband’s death. Leaving the home is incorrect and transgression. This rule applies equally whether a) a woman has had intimacy with her husband during his life-time or not b) she had any kind of privacy with him or not c) she had come to live with him or not d) she menstruates or not e) she is old or young f) she reached the age of puberty or not. 2) A pregnant woman However if the woman was pregnant at the time of the death of her husband, she should remain in Iddah until the child is born then the Iddah will be over. Halal and Haram during the ‘Iddah Things which it is forbidden for a woman to do during Iddah It is forbidden for a woman at the time of Iddah to do the following: 1. To go out of her house, except for a necessary purpose, such as if she is sick and needs to go to the hospital or on emergencies such as if her house is about to fall down and there is the fear that it may collapse on top of her; or in the case of fire; and so on. 2. To wear perfume, because the Prophet (peace and blessings of Allaah be upon him) forbade the grieving woman to put on perfume. (Sahih Bukhari, Volume 7, Book 63, Number 255) 3. To wear beautiful clothes, that are considered to be adornments, she should wear clothes without making herself look beautiful. 4 .She should not put on kuhl or hinna, because the Prophet (peace and blessings of Allaah be upon him) forbade that. 5. She should not wear any jewellery, because if she is forbidden to wear beautiful clothes, it is more appropriate that jewellery should not be allowed. What is permissible? It is permissible for her to speak to men and to speak on the telephone, and to allow people to enter the house who are permitted to do so according to sharee’ah i.e. those who are Mahaarim to her and those who entering is out of necessity e.g. a doctor, a repair man doing repair for water piles and the likes. She may walk barefoot or with shoes in her house. She fulfills her needs in the house, such as cooking her food and the food of her guests. References; 1. WARAKA MAALUM WA WAWAKRISTO ZANZIBAR - TOKA 2009!!!

Umoja wa Wazalendo Zanzibar June 24, 2009 WARAKA MAALUM KWA WAKRISTO ZANZIBAR Wapendwa katika Bwana Ndugu Wakristo umefika wakati tumeonelea kuwa ipo haja ya kuwaelezeni machache ili kuona maendeleo yetu na mafanikio tuliokwisha yapata hapa Zanzibar, yanaendelezwa na hayarudi nyuma kwa namna yoyote. Hapana shaka kuwa munaelewa kuwa idadi yetu hadi sasa bado ni ndogo sana na wengi wetu tungali katika kiwango na hadhi ya wahamiaji na sio Wazanzibari kama wanavyosema wenyewe. MAFANIKIO YETU Kabla kugusia yale ambayo tunahisi ndio lengo la waraka huu hapana budi kuwatajieni mambo machache ambayo tumefanikiwa kuyapata hadi sasa. Pamoja na jitihada zetu za muda mrefu bado tunapaswa tumsifu Bwana kwa msaada wake mkubwa kwetu dhidi ya maadui zetu. Tunaamini kuwa kupitia nguvu za Roho Mtakatifu, Bwana atatupa ushindi na mafanikio makuu zaidi ya haya na atawafumba macho maadui zetu wazidi kulala ili mipango yetu yote ya kuibadilisha Zanzibar kidemografia ifanikiwe katika kipindi kifupi kijacho. Mafanikio yetu yameenea katika kila upande - katika uchumi, siasa, huduma za serikali, umiliki wa ardhi, ujenzi, elimu, n.k. Ili kupata picha kamili ni vyema tuorodheshe kwa ufupi mafanikio hayo: 1. Nafasi yetu kwa upande wa elimu imekua ya kuridhisha kupitia nafasi za serikali. Hivi sasa ni rahisi na limekua jambo la kawaida katika kila matangazo ya wito wa masomo kusikia majina ya Wakristo. Kati ya vijana saba hadi kumi, ni lazima upate vijana wawili hadi watatu kutoka katika makanisa yetu. 2. Sambamba na matangazo ya elimu vijana wetu wamekuwa wanapata nafasi nyingi za ajira katika Serikali ya Zanzibar. Hali ya kutoelewana kisiasa baina ya Wazanzibari imetoa mwanya kwetu kuingiza vijana wa Kikristo wenye asili ya bara kwa wingi kwani wamekuwa wanaaminika zaidi kuliko vijana wa Zanzibar. 3. Hali tulioieleza juu imetuwezesha pia kuwa na Wakristo wengi katika nafasi za juu serikalini na katika chama tawala. Hali hii ni lazima iendelezwe katika ngazi zote kwani imekuwa ikitusaidia hasa katika kiwango cha masheha na kamati zao kwani huku ndiko kunako mambo mengi ya kila siku. 4. Tumepata fursa ya kutumia Taasisi za serikali kwa uendeshaji wa ibada zetu hali hii imefanya tuzidi kukubaliwa na Waislamu na kuvumiliwa na inaweza kutupa nafasi ya kuwavuta katika NENO LA BWANA. 5. Kwa upande wa mashamba (vijijini) tumepata wasaa mzuri wa kununua ardhi toka kwa Waislamu ambao hadi sasa bado hawajashtuka. Ardhi hizi zimetuwezesha kujenga makanisa kadhaa ambayo hapo awali hayakuwepo. 6. Idadi ya skuli na vituo vyetu (ambavyo licha ya picha ya juu kuwa haviendeshwi kwa misingi ya Kikristo lakini kiukweli ni vituo vya kimisionari) vimeongezeka kwa hali ya kuridhisha. Skuli hizi nikuanzia kwa watoto wadogo hadi vituo kama hichi kilichopo Mji Mkongwe (Stone Town Youth Centre) na zinafanya kazi vizuri katika kupandikiza mila za Kikristo. 7. Sera ziliopo hivi sasa kwa upande wa uingiaji na utokaji Zanzibar imetusaidia sana katika uingiaji wetu (Wakristo) kutoka Bara na hivyo kusaidia kufuta ile imani ya kuwa Zanzibar ni kisiwa cha Waislamu na eti Wazanzibari kwa zaidi ya aslimia 99 ni Waislamu. 8. Ujaji wa Wakristo kwa wingi kutoka bara kwa kazi za kiserikali na Chama umewezesha kuongezeka kwa idadi ya mabaa na klabu za pombe kuwahudumia. Hivi sasa ni jambo la kawaida kuona magari ya aina mbalimbali yanayomilikiwa na eti Waislamu yanabeba kreti za pombe kali. 9. Kujiingiza kwetu katika Taasisi za dola katika ngazi za mitaa kumetuwezesha kupata nafasi ya kutangaza Ukristo kwa njia ya mihadhara ya Injili. 10. Tumefanikiwa kupata viwanja vingi katika maeneo ya Mjini ambayo yangali mapya. Maeneo haya ni kama Tomondo, Mombasa, Mwanakwerekwe, n.k. ambayo tayari tumeshajenga makanisa yetu ingawaje kwa sasa hayajawa na waumini wengi wa kuyatumia na bado yanaonekana ni matupu. Ndugu wapendwa katika bwana, Mafanikio hayo yasitufanye tukalewa na kusahau jukumu la kanisa la kuona kuwa utawala wa Bwana unashuka Zanzibar haraka iwezekanavyo. Kosa lolote tutakalofanya hivi sasa litaweza kuturudisha hatua kadhaa na huenda nafasi hii tulionayo hivi sasa tusiipate kwa karne mpya ijayo. Mambo ya kufanya yanayotukabili ili kuimarisha nafasi yetu na kuona yale tuliokwisha yapata hayatutoki na kuyafanyia dira kwa karne ijayo ni haya yafuatayo: Tusahau tafauti zetu dhidi ya adui Ingawaje tupo madhehebu nyingi lakini tunawajibika kuelewa kuwa Waislamu na Uislamu wao ni adui yetu namba moja ambaye hatutofaulu kupambana nae mmoja mmoja. Uislamu hapa Zanzibar ni dini iliofungamana na mila na utamaduni hivyo kila itakapowezekana tusahau tafauti zetu ndogo ndogo na hata kubwa kukabiliana nao, vyenginevyo tutarudi kama wakati wa Karume. Tuhakikishe tunapata ardhi Hii ni mbinu kongwe katika usambazaji wa Ukristo. Wazee wetu walipoleta Ukristo Zanzibar na katika Afrika jitihada waliyofanya ni kupata ardhi kubwa kwa ajili ya ujenzi wa maeneo yetu majengo ya hospitali, shule, zahanati, vituo vya chekechea, makanisa n.k. Tunahitaji ardhi kubwa ili kuziweka huduma hizo mahala pamoja kwa ajili ya kueneza injili ya bwana na Muokozi wetu. Tununue nyumba na viwanja kwa ujenzi wa makanisa Inaonesha Waislamu wenye siasa kali na baadhi ya watendaji kwenye sirikali wameanza kushtuka na ongezeko kubwa la makanisa katika kisiwa cha Unguja. Kuna dalili kuwa tunaweza kupata ugumu katika kupata viwanja kwa ajili ya makanisa. Njia tunayoweza kuitumia kwa muda huu ni kununuwa viwanja vitupu au nyumba za Waislamu kwa bei kubwa itayowashawishi kuviuza na baadae tutaweza kuvijenga au kugeuza nyumba hizo kuwa makanisa. Tujenga shule na hospitali kwa wingi Hizi ni taasisi pekee ambazo tunaweza kuzitumia kueneza neno la Bwana kwa Waislamu walio wengi hapa Zanzibar. Kwa kutumia umasikini unaowakabili wengi ya Wazanzibari na uchache wa huduma hizo tunaweza kujitangaza vizuri, tujitahidi kutoa huduma nzuri kuweka vifaa vya kisasa kuweka bei ndogo kuweka upendo ili vituo vya Waislamu au hata vile vya serikali visiweze kuvikaribia vyetu. Shule ni sehemu muhimu ya kupandikiza mafundisho yetu, zaidi kwa watoto wadogo (Nursery). Tunadai muda zaidi katika Vyombo vya habari (Tv na Redio) Kwa muda mrefu sasa uislamu na waislamu wamehodhi vombo hivi vya habari mbali na kuwa siku ya ijumaa ambayo yote humilikiwa na vipindi vya kiislamu vyombo hivyo hutenga siku nyengine kadhaa kwa vipindi vya kiislamu na hata kuthubutu kutia adhana kila wakati wa sala hali hii inaudhi na inatoa picha ya wazi ya serikali kupendelea uislam ingawaje inadai kuwa haina dini. Wakati wa kusherehekea miaka 25 ya TVZ tulizungumzia suala hili lakini inaonekana halikupata mtu wa kulifanyia kazi. Sasa tuhakikishe kuwa ukristo unapata muda zaidi katika vyombo hivyo au uislam nao upunguziwe nafasi. Tuongeze mihadhara ya wazi Wakati Waislam wamezuiliwa kufanya mihadhara ya wazi, sisi tujitahidi kuhakikisha kuwa mihadhara yetu inaongezeka kwa kiwango kikubwa na inakuwa ya amani kupingana na ile ya kwao ya vurugu. Kwa kuwa Waislamu hawahudhurii mihadhara hiyo, lazima tuone wakristo wa Mjini na Mashamba wanahamasishwa na kupatiwa nyenzo ili kuhudhuria. Vipaza sauti vitumike kuhakikisha kuwa neno la bwana linafika kila pahala. Mihadhara ifanyike karibu na nyumba, misikiti na kwenye viwanja vya wazi. Tuendelee kutumia shule na sehemu za Umma Ili kuwafanya waislamu watuzoee na kuondosha chuki yao kwetu ni lazima kuendelea kutumia mashule na sehemu za Umma zilizo wazi kwa mambo yetu ya ibada kwa kipindi kirefu hali hii inaweza kuwafanya washindwe kuona tafauti kati yetu na wao na hivyo kutuzoea haswa watoto wao. Tufanye suala la uhamiaji Zanzibar kuwa jepesi Uzoefu unaonesha kuwa ni jambo gumu kuwabatiza Wazanzibari waislamu. Hali hii inafanya ongezeko la wakristo kuwa dogo au halipo kabisa ukitoa wale wanaozaliwa katika familia za kikristo. Njia pekee ya kuhakikisha ongezeko la makanisa na Taasisi zetu ni kuongezeka kwa wakristo. Jambo hili litawezekana kwa kuingiza Wakristo wengi kutoka Tanzania Bara au wapagani ambao tutaweza kuwabatiza kwa kutumia udugu wetu wa kikabila au asili ya Bara. Kwa kuwatumia ndugu zetu waliomo serikalini (SMZ au SMT) tuhakikishe kuwa suala la uhamiaji linabakia wazi na rahisi na linaendelea kwa kila hali. Tuzuie jaribio lolote la kadi za uraia au vitambulisho Wakristo tunapaswa kuelewa kuwa iwapo serikali ya Zanzibar itaamua kufanya cho chote ili kuwa na vitambulisho au kadi za uraia kwa wazanzibari pekee basi jambo hilo litaathiri sana mipango yetu ya muda mrefu kwa Zanzibar. Iwapo tutawajibika kuunga mkono ni kadi za Uraia na vitambulisho vya Watanzania kwa Ujumla na sio Zanzibar peke yake. Tujipenyeze Vyamani na kushika nafasi muhimu Lazima tuelewe kuwa chama cho chote cha siasa kinalenga kukamata serikali ili kiweze kutekeleza yale yanayoaminika kuwa ni mazuri kwa chama hicho. Tunapozungumzia vyama vya siasa kwa Zanzibar tunahusisha zaidi kwenye CCM na CUF. Watu wetu wamefaulu kuingia kwa wingi katika chama tawala na katika jumuia zake. Tupenyeze wenzetu serikalini Sambamba na suala tulilolielekeza juu, hatuna budi kusomesha vijana wetu na kuhakikisha kuwa tunatumia kila njia na ushawishi ili kuwaingiza serikalini na hasa katika sehemu muhimu. Hii itarahisisha kuungwa mkono mipango yetu na kupunguzwa vikwazo kwa mikakati yetu. Tuunge mkono sera za utalii Hadi sasa wengi wa watalii wanaoingia Zanzibar hutokea nchi za Kikristo. Desturi za watalii hupingana na zile za Kizanzibari na hata za Kiislamu. Watalii wanasaidia kuongezeka kwa mabaa na vivazi ambavyo waislamu wanataka visivaliwe hasa na wanawake. Hali hii ni lazima iongezeke ili udhibiti wa shughuli za waislam uwe mzuri zaidi na wakati huo huo kuona kuwa mambo yetu yanakwenda yakiwa na baraka ya vyombo vya dola na vyama vya siasa. Tabligh inaweza kuwazindua baadhi ya waislam ambao ni vyema kubaki bila ya kuzinduliwa. Tulete waumini kutoka mashamba kuanza makanisa Hivi sasa pameibuka wasi wasi kuhusiana na wingi wa makanisa ambayo hayajapata waumini wa kuyajaza. (AP) — Muslims in a Tennessee congregation prepared Thursday for the holy month of Ramadan a day after a federal judge ruled they have a right to occupy their newly built mosque, overruling a county judge's order that was keeping them out. The Islamic Center of Murfreesboro sued Rutherford County on Wednesday and asked U.S. District Judge Todd Campbell for an emergency order to let worshippers into the building before the holy month of Ramadan starts at sundown Thursday. Federal prosecutors also filed a similar lawsuit. The future of the mosque had been in question since May, when a local judge overturned the county's approval of the mosque construction. This month, he ordered the county not to issue an occupancy permit for the 12,000-square-foot building. Campbell ordered the county to move ahead on approving the mosque for use, although it wasn't immediately clear if that could happen by Thursday. Final inspection of the building is required. The contentious fight over the mosque stems from a 2010 lawsuit filed by a group of residents who made repeated claims that Islam was not a real religion and that local Muslims intended to overthrow the U.S. Constitution in favor of Islamic religious law. Those claims were dismissed, but opponents won with a ruling that overturned the approval to build the mosque on the grounds that county didn't give adequate public notice of the meeting. Although the county advertised that meeting in the same way it has advertised others, the judge said extra notice was needed because the mosque construction was "an issue of major importance to citizens." In court Wednesday, U.S. Attorney Jerry Martin said the chancery court judge, in essence, created a separate "mosque standard" applicable only to someone who wants to build a mosque. [Related: Muslim Americans use comedy to break down stereotypes] Citing acts of vandalism, arson and a bomb threat against the Islamic Center of Murfreesboro, Martin said, "The Muslim community in Rutherford County has been under siege for the last two years. Now, after doing everything right, they are told that they can't move in." Martin asked the federal judge to fulfill a promise made by the congregation's religious leader, Imam Ossama Bahloul, to the children of the congregation that justice would be done and they would be allowed to worship in their new space. The congregation is being represented by The Becket Fund for Religious Liberty and local civil rights attorney George Barrett. The lawsuit filed in federal court in Nashville alleges violations of federal law and the constitutional guarantees of freedom of religion and equal protection. "If ICM were a Christian church, it would have been granted a certificate of occupancy and would be worshipping in its new facility today," a memorandum to the federal court reads, citing 20 instances of Christian churches that have been allowed to build since 2000. " ... The discriminatory treatment of the mosque also sends a powerful message to the Muslim community that they are second-class citizens, not worthy of the same rights or protection as Christian churches." Attorneys for Rutherford County did not oppose the temporary restraining order. County attorneys have argued in chancery court hearings that treating the mosque differently from other applicants was discriminatory and a violation of their rights. County Attorney Jim Cope said after the hearing that he felt vindicated by Campbell's ruling. Mosque leader Bahloul said he had been reluctant to involve the mosque in the lawsuit but felt he had no choice after the certificate of occupancy was refused. He said Campbell's ruling means a lot to Muslims in Tennessee and their supporters. "I think this is an opportunity for us all to celebrate the freedom and liberty that, in fact, exist in America and to teach our young people to believe even more in the U.S. Constitution," he said. An attorney for the mosque opponents did not return a call seeking comment.
